Checklist Before Buying Property in India as an NRI

Title chain, RERA, encumbrance, tax — the 24-point checklist we use internally.

Title and ownership

Verify the title chain for at least 30 years. Obtain an up-to-date encumbrance certificate. Cross-check the seller's identity, PAN and authority to sell. For inherited property, confirm succession documents and no-objection certificates from all legal heirs.

Regulatory

For under-construction property, verify RERA registration on the state RERA portal. Check the approved building plan, occupancy certificate and commencement certificate. Confirm land use matches the intended purpose.

Financial and tax

Compute applicable TDS under section 195 if buying from another NRI. Plan repatriation of sale proceeds in advance. Set up an NRO or NRE account aligned with the source of funds. Keep all wire receipts — they matter at resale.
