Special PoA drafted by an Indian advocate, signed before a Canadian notary public, authenticated by Global Affairs Canada (or provincial competent authority), attested at the Indian consulate (Toronto or Vancouver) or High Commission (Ottawa), and registered at the sub-registrar in India.

Buying property in India from Canada

Title chain verification, RERA check, encumbrance certificate, sale agreement vetting and registration — handled in your absence with a Special PoA. We never recommend a project we haven't physically inspected.

Yes. With a Special Power of Attorney drafted in India, signed before a Canadian notary, authenticated by Global Affairs Canada and attested at the Indian consulate, the purchase and registration can be completed in your absence.

How do I authenticate a Power of Attorney in Canada?

Sign before a Canadian notary public → authenticate at Global Affairs Canada in Ottawa (or provincial competent authority where applicable) → attestation at the Indian consulate (Toronto or Vancouver) or High Commission (Ottawa). Canada is not a Hague Apostille country, so authentication-attestation is used instead of apostille.

Can NRIs claim TDS refund on property sale and repatriate to a Canadian account?

Yes. We file Form 13 for lower TDS, then ITR for any refund, and Form 15CA/15CB for repatriation to your Canadian account, up to USD 1 million per year per NRI.
