Frequently asked questions

Can an NRI file a partition suit in India without coming back?

Yes. With a properly drafted Power of Attorney, your advocate can file, appear, lead evidence and argue the matter end to end. You may need to depose by video conference for one or two hearings.

What is the difference between a succession certificate and a Letter of Administration?

A succession certificate is for movable assets like bank balances, fixed deposits and shares. A Letter of Administration / probate is needed for immovable property and to act on a will.

How long do partition cases typically take?

Contested partition suits typically run 18–36 months in trial court. Uncontested family-settled partitions can be completed in 2–4 months via a registered partition deed, which we always attempt first.
