A Power of Attorney (PoA) is the single most powerful — and most dangerous — document an NRI can sign. Done well, it lets a trusted person handle property sale, bank work, court filings or registration on your behalf without you flying back. Done badly, it is the leading cause of NRI property loss in India.

What we do, step by step

Drafting — narrow, not general

We draft a Special Power of Attorney scoped to one specific transaction (e.g. 'sale of flat at address X for not less than ₹Y'). No blanket authority to sell, mortgage or lease anything else.

Apostille coordination in your country

We provide a checklist for notarisation and apostille at the Indian consulate in the USA, UK or Canada, including the right office, fee and turnaround. You sign in front of a notary, courier the document, and we take it from there.

Registration in India

Once the apostilled PoA reaches India, our advocate adjudicates stamp duty and registers it at the relevant sub-registrar within 90 days, as required by law.

Execution of the underlying task

Our advocate then uses the PoA only for the specific purpose drafted — sale registration, court appearance, bank closure or mutation — and shares signed copies of every step with you.

Safe revocation

When the task is done, we draft and register the deed of revocation, publish a public notice and intimate all relevant authorities so the PoA cannot be misused later.

Frequently asked questions

Can I sign a Power of Attorney in the USA / UK / Canada and use it in India?

Yes. The PoA must be signed before a notary in your country, apostilled at the Indian consulate (or the country's competent authority), and registered at the relevant sub-registrar in India within 90 days of arrival. We coordinate every step.

Should I give a General Power of Attorney to my family?

Almost never. A General PoA gives the holder authority to sell, lease or mortgage any of your property. We strongly recommend a Special PoA limited to one named transaction, with a clear expiry date.

How long does the full process take?

Typically 3–4 weeks end to end — 3–10 days for drafting and your apostille, then 10–15 days for stamp duty and registration in India.

Can the PoA be revoked?

Yes. We draft and register a deed of revocation, publish a public notice in a local newspaper, and notify all relevant authorities (society, sub-registrar, banks).
