Power of Attorney in India From the USA — A Practical Guide

If you live in the USA and need a Power of Attorney in India

Almost every Indian property, court or bank matter can be handled in your absence — but only if your Power of Attorney (PoA) is drafted in India, signed in the USA before a notary, apostilled, and then registered at the relevant Indian sub-registrar within 90 days. Skipping any step makes the PoA legally weak and easy to challenge.

The single most expensive mistake we see is a General Power of Attorney drafted by a non-specialist in the USA and used to sell Indian property. Indian sub-registrars and courts treat these as suspect, and family disputes over them are common.

The correct 4-step process

1. Drafting in India — Have an Indian advocate draft a Special Power of Attorney scoped to one specific task (e.g. sale of a specific flat, with a floor price). Avoid blanket powers.

2. Notarisation in the USA — Sign before a US notary public. Some states require county-clerk verification of the notary.

3. Apostille — Apostille the PoA at the Secretary of State of the US state where notarised. Then attest at the Indian consulate with jurisdiction over that state (Houston, New York, San Francisco, Chicago or Atlanta).

4. Registration in India — Courier to India. Within 90 days, the PoA holder pays stamp duty and registers the PoA at the sub-registrar where the property is located.

Common questions from US-based NRIs

How long does it take? Typically 3–4 weeks end to end if you act on the apostille within a week of receiving the draft. Can a family member be the PoA holder? Yes, but choose carefully and keep the scope narrow. Can it be revoked? Yes — by registered deed of revocation, public notice and intimation to all relevant authorities.
